In short
IP strategy decides what to protect, where, and how to use it. Inovatree runs patentability, landscape, invalidity and freedom-to-operate (clearance) analyses, manages IP portfolios, structures licensing deals, monitors competitors and builds IP frameworks so innovative businesses protect the right assets and avoid infringing others.
What we do
Patentability analysis
Before you invest in drafting, we test whether the invention is new, non-obvious and useful. A novelty search compares it with prior art to confirm it has not been disclosed or used before.
Patent landscape analysis
A map of who is patenting what in your field, how the technology and market are moving, and where the white space is. It guides research direction and investment.
Invalidity analysis
If a competitor asserts a patent against you, prior art that invalidates its claims is usually the first line of defence. We search for and analyse that art claim by claim.
Clearance (freedom to operate)
A search before launch that checks whether your product could infringe existing patents, designs or trademarks, so a small resemblance does not turn into a costly dispute affecting manufacturing and marketing.
Portfolio management
We help you build and maintain a coherent portfolio that keeps its value, deters competitors, preserves freedom to operate and makes the business more attractive to investors.
IP licensing
Licensing shares IP and generates revenue. We structure technology licences for patents, know-how, trade secrets and designs, as well as copyright and trademark licences.
Competitor watch
Regular monitoring of competitors' filings and publications so you see threats and opportunities early.
IP framework and training
An IP policy and process for innovative businesses and institutions, covering invention disclosure, ownership, confidentiality and filing decisions, with training for your team.
How we work
- 1Define the question
Launching a product, raising funds, defending a claim or planning R&D: each needs a different analysis.
- 2Search and analyse
We search patent and non-patent literature and analyse results against your goal.
- 3Report and recommend
A clear report with findings, risk levels and specific next steps, not just a list of documents.
- 4Execute
Filing, licensing, opposing or designing around: we carry the recommendation through.
Frequently asked questions
What is a freedom to operate search?
A freedom to operate (FTO) or clearance search checks whether making or selling a product in a given country could infringe someone else's in-force patents or other IP rights. It is done before launch, country by country, because patents are territorial.
How is a patentability search different from FTO?
A patentability search asks whether your invention is new and inventive enough to be patented. An FTO search asks whether your product infringes others' rights. An invention can be patentable and still infringe an earlier broader patent.
Why do investors care about an IP portfolio?
Registered IP gives a company exclusive rights it can enforce, license or sell. A well-managed portfolio shows that key technology and brands are owned by the company and protected, which reduces risk in due diligence.
Can an IP licence be exclusive in India?
Yes. Licences can be exclusive, sole or non-exclusive and can be limited by territory, field of use and time. Patent licences and assignments must be in writing and registered with the Patent Office to be effective against third parties.
